Terms of Service for First Marker

1. Acceptance of Terms

By using First Marker ("the App"), you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the App.

2. App Functionality and Limitations

  • The App helps educators use AI to grade test scripts.
  • It requires legible handwriting for accurate results.
  • AI may make mistakes; human oversight is essential.

3. User Responsibility for Student Privacy

  • Do not upload personally identifiable student info.
  • Use student IDs or pseudonyms instead of names.
  • Ensure institutional permissions are in place.

4. User Content

You retain ownership of your uploaded data. We only process it to provide app features.

5. Credits, Purchases, and Referral Bonuses

Credits are a virtual unit used within the App to access grading and answer-key generation features. Credits have no monetary value, are not redeemable for cash or any other item of monetary value, and cannot be sold, traded, gifted, or transferred to any other user or account.

Credits may be obtained by (a) purchasing a credit pack through the App's in-app purchase system, or (b) earning a limited bonus through the App's referral program, subject to eligibility limits described in the App.

Referral bonuses are a promotional incentive at our discretion and may be modified, limited, or discontinued at any time without notice. Credits obtained through referrals are subject to the same restrictions as purchased credits and carry no cash value.

Unused credits may be forfeited if your account is terminated for a violation of these Terms. Credits are non-refundable except as required by applicable law or your device platform's purchase policies.

6. Prohibited Uses

  • No illegal or abusive content.
  • No violations of student privacy laws.
  • No reverse engineering or misuse of the App.

7. Disclaimer of Warranties

The App is provided "as is" without guarantees of accuracy or uninterrupted service.

8. Limitation of Liability

We are not liable for any damages arising from use of the App, including grading errors.

9. Modifications to Terms

We may update these terms. Continued use of the App means you accept the changes.
